These Website Terms and Conditions (“Terms”) govern your access to and use of the website operated by to Bridgewest Finance Management Australia Pty Ltd (ACN 685 993 257) and Bridgewest Finance NZ Limited Partnership (NZBN 9429050041053) (“Bridgewest Finance”, “we”, “us”, “our”) at www.bridgewestfinance.com (the “Website”). By accessing or using the Website, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you must immediately cease using the Website. 

1. Eligibility and Use of Website 

1.1. Eligibility: The Website is intended for use by individuals and entities located in Australia who are at least 18 years of age or have the legal capacity to enter into binding agreements. By using the Website, you represent and warrant that you meet these eligibility requirements. 

1.2. Lawful Use: You must use the Website for lawful purposes only and in accordance with the Competition and Consumer Act 2010 (Cth) (Australia) and the Commerce Act 1986 and the Fair Trading Act 1986 (New Zealand) other applicable Australian and New Zealand laws. 1.3. Broker and Referrer Responsibilities: Finance brokers, intermediaries, or third-party referrers accessing or using the Website on behalf of clients must: 

Obtain and maintain appropriate written authority and consents to act on behalf of their clients; 
Ensure all personal or financial information disclosed complies with the Privacy Act 1988 (Cth) and the Privacy (Credit Reporting) Code 2021; and the New Zealand Privacy Act 2020 (New Zealand);  
Provide evidence of client consent upon Bridgewest Finance’s request; 
Verify the accuracy and completeness of all information provided. 

1.4. Prohibited Conduct: You must not: 

Attempt to gain unauthorised access to the Website, its systems, or any related networks; 
Use automated tools (e.g., bots, scrapers) to extract data or content; 
Introduce viruses, malware, or other harmful code; 
Engage in activities that disrupt or impair the Website’s functionality, such as denial-of-service attacks; 
Reverse-engineer, decompile, or disassemble any Website software or code.

2.3. Risk Acknowledgment: Decisions based on Website information are at your sole risk. Bridgewest Finance is not liable for any outcomes resulting from your reliance on such information.  

3. Submissions by Brokers and Intermediaries 

3.1. Authority and Compliance: Brokers, introducers, or intermediaries submitting borrower, guarantor, or other client information via the Website represent and warrant that: 

They are duly authorised in writing to act on behalf of the relevant individual(s) or entity; 
All information provided is true, accurate, complete, and not misleading; 
They have obtained all necessary consents and provided required disclosures in compliance with the Privacy Act 1988 (Cth) and the Privacy (Credit Reporting) Code 2021; and the New Zealand Privacy Act 2020 (New Zealand); 

3.2. Liability for Unauthorised Submissions: Bridgewest Finance is not liable for any unauthorised disclosure, misuse, or loss of personal or financial information submitted by a third party without proper authority. All third parties, including introducers or intermediaries, indemnify Bridgewest Finance against any claims, losses, damages, or expenses (including legal fees) arising from their failure to comply with this clause. 

3.3. Data Retention: Bridgewest Finance may retain submitted information in accordance with its Privacy Policy and legal obligations, including under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) and the Anti-Money Laundering and Countering Financing of Terrorism Act 2009 (New Zealand). 

4. Intellectual Property 

4.1. Ownership: All content on the Website, including text, graphics, images, logos, trade names, designs, layouts, software, and databases, is owned by or licensed to Bridgewest Finance and is protected by Australian and international copyright, trademark, and other intellectual property laws.

8.2. Jurisdiction: You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales and any courts competent to hear appeals from those courts for any disputes arising from these Terms or your use of the Website. 

9. Complaints and Dispute Resolution 

9.1. No AFCA Membership: Bridgewest Finance is not a member of the Australian Financial Complaints Authority (AFCA) and is not required to participate in its dispute resolution scheme as a non-bank commercial lender.

10. Changes to These Terms
